Title Senior Living and Hotel Owners in California Agree to $1.5+ Million Asbestos Settlement
Introduction LA Testing provides asbestos testing services, sampling supplies, test kits and personal protective equipment to identify and mitigate asbestos exposure risks, and to help companies comply with health and safety regulations.

Huntington Beach, California, August 21, 2023

In July, Monterey County District Attorney Jeannine M. Pacioni announced that her Environmental Protection Unit, along with ten other District Attorney and City Attorney Offices throughout California, had reached a settlement with a luxury senior living and hotel operator for violations of asbestos-related laws and regulations. The stipulated judgment was filed in Monterey County and was brought by the District Attorneys of Monterey, Alameda, Kern, Los Angeles, Orange, Riverside, San Bernardino, San Diego, Sonoma and Ventura Counties, as well as the City Attorney of Los Angeles.
According to the Monterey County District Attorney, the case arose when the Monterey Bay Air Resources District (MBARD) received a complaint that unpermitted work was being conducted at a senior living facility in Monterey. MBARD discovered that contractors had conducted renovation and demolition activities without first thoroughly inspecting for asbestos and without notifying MBARD prior to demolition, as required by the federal asbestos National Emission Standards for Hazardous Air Pollutants for demolitions and renovations, incorporated into MBARD’s Rule 424. Additionally, contractors had disturbed asbestos-containing fireproofing material during their work, without taking proper safety precautions to prevent the emission of asbestos. The investigation by the prosecutors revealed many other violations for failing to test for asbestos prior to renovation and demolition activities at other locations owned by the company throughout California.
“In this settlement, the business agreed to pay a total of $1,575,000 to settle the case,” said Michael Chapman, Laboratory Manager of LA Testing’s Huntington Beach facility. “At LA Testing, our California laboratories offer material, industrial hygiene and environmental testing for asbestos. We also provide sampling supplies, easy-to-use test kits, air monitoring instruments and a comprehensive range of personal protective equipment (PPE). These services and resources protect building occupants and workers, and can be instrumental in helping companies avoid these types of costly health and safety penalties.”
