Beginning on January 1st of this year, residential landlords in California are now required to provide a physical copy of a 4-page booklet from the California Department of Public Health (CDPH) to prospective residential tenants prior to entering a rental or lease agreement in accordance with the 2001 Toxic Mold Protection Act (HSC #26148). The booklet, Information on Dampness and Mold for Renters in California, explains the potential health risks that may result from exposure to mold. It was produced by CDPH in 2020 and is available in both English and Spanish versions.
The main points of the booklet include:
- Living in damp or moldy buildings increases the chances of respiratory problems like asthma.
- The critical warning signs are visible mold, water damage, damp materials, or a mold smell.
- Dampness is needed for mold to grow, so if dampness is controlled, mold can be controlled.
- Dampness or mold indoors may make housing substandard, per the California Health & Safety Code.
