Title California Court Challenge to the Proposition 65 Listing of BPA Fails

In October, an appellate court in California upheld the listing of bisphenol A (BPA) as a reproductive toxicant under the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). The listing had been challenged by an industry trade association that represents chemical companies.

Proposition 65 requires businesses to notify Californians about significant amounts of chemicals in the products they purchase, in their homes or workplaces, or that are released into the environment. BPA was first listed for developmental toxicity in 2013 and for female reproductive toxicity in 2015.

Exposure to BPA has come under growing scrutiny in recent years as some studies have found that a large percentage of the population has the chemical in their bodies. BPA is used to manufacture polycarbonate plastics, which are used to make some types of beverage containers, compact disks, plastic dinnerware, impact-resistant safety equipment, automobile parts and toys. BPA epoxy resins are used in the protective linings of some food cans, in dental sealants and in other products.

“The primary source of BPA exposure for most people is through their diet from the chemical leaching into foods or beverages from containers or food wraps,” said Joseph Frasca, Senior Vice President of Marketing at LA Testing. “Occupational exposures can also occur with workers from industries that manufacture products that contain it.
