California Judge Rules Out Lead Warnings on Baby Food Packaging

In 2011, the Environmental Law Foundation (ELF), a non-profit organization, filed a lawsuit that alleged that some children and baby foods contained lead.  The lawsuit questioned whether the food manufacturers are required by Proposition 65 to place warnings on their fruit, vegetable and grape drink products.

In California, lead is listed on the Safe Drinking Water and Toxic Enforcement Act of 1986, which is better known by its original name of Proposition 65.  Lead was added to the Prop 65 list in 1987, shortly after the list was formed.

Just recently, a judge released a tentative ruling that has determined that lead warnings will not be necessary on the food packaging in question.  Lead is a highly toxic metal and is dangerous to all people, but especially to children.  According to the Centers for Disease Control and Prevention (CDC), “There are approximately half a million U.S. children ages 1-5 with blood lead levels above 5 micrograms per deciliter (µg/dL), the reference level at which CDC recommends public health actions be initiated.”
