Title Lawsuit Filed by California against Food Retailers for Products Containing Lead

Earlier this month, it was announced that the California Attorney General’s office had filed a lawsuit in San Francisco Superior Court against a number of well known food retailers.  The lawsuit claims the retailers sold ginger and plume candies that contained lead.

In 1986, California voters approved an initiative to address increasing concerns over exposure to toxic chemicals and materials such as lead. That initiative, the Safe Drinking Water and Toxic Enforcement Act of 1986, is better known by its original name of Proposition 65.  It requires businesses to notify Californians about significant amounts of certain chemicals and materials in the products they purchase and this list includes lead which was added to the Prop 65 list in 1987.

People can be exposed to lead in many ways.  It can occur through exposure to contaminated air, drinking water, food, soil, deteriorating lead-based paints and even dust. Lead-based paint is one of the most significant sources of lead exposure. Many homes built before 1960 contain heavily leaded paint. Some homes built as recently as the late 1970s also contain lead-based paint.
